TRASH REMOVAL TIMELINE
ORDINANCE
Village of Alger, Ohio
WHEREAS, the Village Council of the Village of Alger, Ohio has determined that the accumulation of trash and refuse on Village of Alger right of ways poses a threat to the public health, safety, and welfare of Village residents; and
WHEREAS, the Village Council has the authority to regulate matters affecting the public health, safety, and welfare pursuant to Article XVIII, Section 3 of the Ohio Constitution and Ohio Revised Code Section 713.06; and
WHEREAS, the Village Council desires to establish standards for the timely removal of trash from village right of ways and to provide for enforcement mechanisms to ensure compliance with such standards. Without such standards the Water and Sewer Departments access to its equipment within Village of Alger property could be affected.
NOW, THEREFORE, BE IT ORDAINED by the Village Council of the Village of Alger, Ohio, as follows:
SECTION 1. PURPOSE AND AUTHORITY
The Village of Alger hereby enacts this Ordinance to promote the health, safety, and
welfare of its residents by regulating the disposal and removal of trash and other refuse on Village of Alger rights of ways within the Village and to provide for adequate access to utility improvements. This Ordinance is adopted pursuant to the Village's general police powers and the authority granted under Ohio Revised Code Section 713.06.
SECTION 2. DEFINITIONS
For the purposes of this Ordinance, the following terms shall have the meanings ascribed to them:
l. "Trash" shall mean any solid waste, including but not limited to garbage, rubbish, refuse, and other discarded materials, generated by a Disposing Property and its occupants.
2. "Disposing Property" shall mean any right of way within any residential property within the Village of Alger.
3. "Owner" shall mean the record owner of a Disposing Property, or the tenant or occupant of such property if the property is rented or leased.
4. "Code Enforcement Officer" shall mean the Village employee or designee responsible for enforcing this Ordinance and other Village codes and ordinances.
5. "Village Manager" shall mean the Mayor of the Village or their designee.
SECTION 3. TRASH REMOVAL REQUIREMENTS
1. All Trash generated on a Disposing Property shall be removed from the property within forty-eight (48) hours of being placed or generated on the property.
2. Owners shall be responsible for ensuring that Trash is properly disposed of and removed from their Disposing Property in accordance with this Ordinance.
3. Trash shall be placed at the designated collection point no earlier than 6:00 p.m. on the day before scheduled collection.
4. Empty receptacles shall be removed from the collection point by 6:00 p.m. on the day after collection.
SECTION 4. ENFORCEMENT AND PENALTIES
1. The Code Enforcement Officer shall be responsible for the enforcement of this Ordinance.
2. Any Owner who fails to comply with the requirements of this Ordinance shall be subject to a fine of twenty dollars ($20.00) per instance of non-compliance. An "instance" shall be considered each time the Mayor notifies the owner that they are not in compliance.
3. Prior to imposing a fine, the Code Enforcement Officer shall provide written notice of the violation to the Owner, which shall include:
a. The specific violation;
b. The corrective action required;
c. A statement that failure to correct the violation within twenty-four (24) hours may result in the imposition of a fine; and
d. Information regarding the Owner's right to appeal.
5. The Village may pursue any other legal remedies available to ensure compliance with this Ordinance, including but not limited to the issuance of citations, the initiation of civil or criminal proceedings, and the placement ofliens on the Disposing Property.
6. The fine may be certified to the County and placed on the property tax costs for the property if not paid within 30 days.
7. In cases where the accumulation of Trash presents an immediate threat to public health or
safety, the Village may, after providing reasonable notice to the Owner, enter the property and remove the Trash. The cost of such removal, plus an administrative fee of twenty percent (20%), shall be charged to the Owner.
SECTION 5. IMPLEMENTATION AND REPORTING
1. The Code Enforcement Officer shall maintain records of alI violations and fines issued under this Ordinance.
2. The Code Enforcement Officer shall provide a quarterly report to the Village Manager and an annual report to the Village Council detailing the enforcement activities and outcomes under this Ordinance.
SECTION 6. EXEMPTIONS AND SPECIAL CIRCUMSTANCES
1. The Village Manager may grant temporary exemptions from the requirements of this Ordinance in the following circumstances:
1. During and immediately following Village-approved special events;
2. During periods of natural disaster or emergency, as declared by the
Village, County, State, or Federal government;
3. During periods of construction or renovation, provided that the Owner has obtained all necessary permits and maintains the site in a safe and orderly manner; or
4. In cases of demonstrated economic hardship or medical necessity, as determined by the Village Manager.
2. Requests for exemptions must be submitted in writing to the Village Manager at least five (5) business days prior to the requested exemption period, except in cases of emergency.
3. The Village Manager shall maintain records of all exemptions granted and shall include this information in the annual report to the Village Council.
SECTION 7. PUBLIC EDUCATION AND OUTREACH
l. The Village can, if it elects, develop and implement a comprehensive public education and outreach program to inform residents about the requirements of
this Ordinance.
2. The Village shall provide updated information to residents whenever there are significant changes to waste collection services or procedures.
SECTION 8. APPEALS
1. Any Owner who receives a notice of violation or fine pursuant to this Ordinance may appeal the action to the Village Manager within ten (10) days of receipt of the notice.
2. The appeal must be submitted in writing and must specify the grounds for the appeal.
3. The Village Manager shall conduct a hearing and render a decision on the appeal within fifteen (15) days ofreceipt of the appeal.
4. If the Owner is dissatisfied with the Village Manager's decision, the Owner may further appeal to the Village Council within ten (l 0) days of receiving the Village Manager's decision.
5. The Village Council shall consider the appeal at its next regularly scheduled meeting and shall render a decision within thirty (30) days thereafter. The decision of the Village Council shall be final.
6. During the pendency of an appeal, the Village may suspend enforcement actions, including the imposition of fines, at the discretion of the Village Manager.
SECTION 9. SEVERABILITY
If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of the Ordinance that can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be
severable.
SECTION 10. LIABILITY
1. Nothing in this Ordinance shall be construed to create any liability on the part of the Village or its officials, officers, employees, or agents for any damages that may result from reliance on this Ordinance or any administrative decision lawfully made
thereunder.
2. Owners shall remain liable for any environmental damage, public health hazards, or other adverse impacts resulting from improper disposal or management of Trash on their Disposing Property.
3. In the event that the Village is required to take action to remediate conditions caused by an Owner's non-compliance with this Ordinance, the Owner shall be liable for all costs incurred by the Village, including but not limited to personnel costs, equipment costs, disposal fees, and administrative expenses.
SECTION 11. EFFECTIVE DATE
This Ordinance shall take effect thirty (30) days after its adoption by the Village

LEGAL NOTICE
The Hale Township Trustees will hold their year end meeting on Monday, December 29, 2025 at 7:00 P.M. at the Township Office located at 206 South West Street in Mt. Victory, Ohio.
The Zoning Commission Board and Zoning Board of Appeals will meet on Monday, January 5, 2026 at 7:00 P.M. to reorganize and discuss zoning issues or situations from 2025. Further , the regular meeting for Hale Township will be held on Monday, January 5, 2026 at 7:30 P.M.
